Distance Sales Agreement

1. Parties

SELLER: the company identified below, owner of the Belithos brand. BUYER: the natural or legal person who places an order on belithos.com, whose name or trade name, delivery address, email address and telephone number are those stated in the order form and the proforma invoice or order confirmation issued for that order.

2. Subject

The subject of this agreement is the sale and delivery to the Buyer of the natural stone products ordered on belithos.com, and the parties' rights and obligations under Law No. 6502 on Consumer Protection and the Distance Contracts Regulation. The Buyer confirms that they have read the preliminary information on the products, the price including all taxes and delivery charges, the payment and delivery terms and the right of withdrawal, and have confirmed that they received it electronically.

3. Products and Price

The main features, quantity, finish and dimensions of each product are those stated on its product page and in the order confirmation. The sale price is stated in the currency shown when the order is placed (USD, EUR, GBP, AED or KWD) and includes worldwide express delivery, custom crating, transit insurance and destination import duties and taxes (DDP), as set out in the Delivery & Returns policy. Prices for bespoke dimensions, alternative stone selections or destination-specific logistics are confirmed in the proforma invoice before the agreement is concluded.

4. Conclusion of the Agreement and Payment

An Order Inquiry or Bespoke Inquiry is a request for a proforma invoice, not a purchase. The agreement is concluded when the Buyer confirms the proforma invoice or order confirmation and payment is completed by the agreed method — a secure payment link issued by the Seller, or an international bank wire. Card payments are processed by a licensed payment institution; the Seller does not receive or store the Buyer's card details.

5. Delivery and Risk

Products are delivered to the delivery address given by the Buyer, in the period stated in the Delivery & Returns policy or, for bespoke orders, in the proforma invoice. Unless a longer period has been agreed in writing, delivery is made within thirty (30) days of the order. The risk of loss or damage in transit remains with the Seller until the products are delivered to the Buyer or a person designated by the Buyer. If the Seller cannot deliver within the agreed period, the Buyer may cancel the agreement and the Seller will refund all payments received within fourteen (14) days.

6. Right of Withdrawal (Consumers)

A Buyer who is a consumer may withdraw from this agreement within fourteen (14) days of receiving the products, without giving any reason and without penalty. To do so, the Buyer must notify the Seller in writing within that period — by email to info@belithos.com or by letter to the address above — and must return the products within ten (10) days of the notice.

1. The products must be returned unused and undamaged, in their original condition and, wherever possible, in the original crate and packaging; the Buyer is liable for any loss in value resulting from use beyond what is needed to inspect the product.
2. The Seller will refund all payments received, including the standard delivery charge, within fourteen (14) days of receiving the notice of withdrawal, using the same payment method as the Buyer.
3. The Buyer bears the direct cost of returning the products. Return shipping of crated stone is arranged with the Seller so that it travels safely.

7. Exceptions to the Right of Withdrawal

In accordance with Article 15 of the Distance Contracts Regulation, the right of withdrawal does not apply to products prepared according to the Buyer's specifications or personal needs. This includes bespoke dimensions, custom finishes, custom stone selections and engraving or branding made to order. Natural variation in the veining, colour and texture of the stone is a characteristic of the material and is not a defect.

8. Commercial Buyers

The right of withdrawal under Law No. 6502 applies to consumers only. A Buyer who orders for commercial or professional purposes is bound by the terms of the proforma invoice, and the remedies for goods damaged in transit described in clause 9 apply to all Buyers.

9. Damaged or Defective Products

The Buyer should inspect the crate and its contents on delivery and, where possible, have the courier record any damage. Products damaged in transit are replaced or refunded in accordance with the Delivery & Returns policy, which allows fourteen (14) days from delivery to report damage. The Buyer's statutory rights in respect of defective goods under Article 11 of Law No. 6502 are not limited by this agreement.

10. Intellectual Property

All product photography, renders, text and the Belithos name and mark are the property of the Seller and may not be reproduced, distributed or used commercially without prior written consent.

11. Governing Law and Dispute Resolution

This agreement is governed by the laws of the Republic of Turkey. For disputes with consumers, the Consumer Arbitration Committees and Consumer Courts are competent within the monetary limits announced each year by the Ministry of Trade; a Buyer resident outside Turkey also keeps the mandatory consumer-protection rights of their country of residence. For disputes with commercial Buyers, the courts and enforcement offices of Denizli are competent.

12. Effect

The Buyer is deemed to have read and accepted all clauses of this agreement, together with the preliminary information, when they confirm the order electronically. The agreement takes effect on the date of that confirmation.
